General Terms and Conditions of Sale (GTCS)
Preamble
These general terms and conditions of sale (GTCS) govern the contractual relationship between Naturopharma, whose registered office is located at 83 Boulevard du Président Wilson, 06400 Antibes, FRANCE, registered with the Antibes Trade and Companies Registry under number 89766276, and any individual or legal entity (hereinafter referred to as "the Customer") wishing to make a purchase from the website. www.naturopharma.net (hereinafter "the Site").

By validating his/her order, the Customer accepts these GTC without reservation.
1. Subject
The purpose of these GCS is to define the rights and obligations of the parties in the context of the online sale of products offered by Naturopharma to the Customer.
2. Products
The products offered for sale are those described on the Site. Naturopharma makes every effort to present and describe its products as accurately as possible. However, Naturopharma cannot be held responsible for any errors or omissions in this presentation. Photographs of products are not contractual.
3. Awards
Product prices are indicated in euros (€), inclusive of all taxes (TTC), excluding delivery costs. Naturopharma reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time the order is placed. Delivery costs are invoiced in addition and indicated before the order is validated by the Customer.
4. Control
4.1. Ordering process
The Customer places an order by following the process indicated on the Site. After selecting the desired products, the Customer must check and, if necessary, correct the contents of their basket before validating their order.
4.2 Order Confirmation
Naturopharma shall confirm receipt of the order by sending an email to the Customer. The sale shall not be considered final until this confirmation email has been sent and the order price has been received.
5. Payment
Payment may be made by bank card, bank transfer or any other payment method offered on the Site. Credit card payments are secured by our payment service provider. Naturopharma reserves the right to suspend or cancel any order in the event of non-payment or payment incident.
6. Delivery
6.1. Delivery terms
Products are delivered to the delivery address indicated by the Customer at the time of ordering. Naturopharma delivers in France and abroad.
6.2. Delivery times
Delivery times are indicated on the Site and may vary depending on the destination. These times are given as an indication and do not constitute a commitment on the part of Naturopharma.
6.3. Receipt of the Order
The Customer is required to check the condition of the products delivered. In the event of damage or shortages, the Customer must make all necessary reservations on the delivery note and inform Naturopharma within 48 hours.
7. Withdrawal and returns
7.1. Right of Withdrawal
In accordance with current legislation, the Customer has a cooling-off period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify his decision or pay any penalties.
7.2. Return procedure
Products must be returned in their original packaging, in perfect condition, accompanied by the purchase invoice, to the following address: QUIVO, Naturopharma, 62 Bd Henri Navier Lot 1-3, 95150 Taverny, France . The cost of returning the product shall be borne by the Customer, except in the case of a defective product or error on the part of Naturopharma.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to :
The supply of services which are fully performed before the end of the withdrawal period and where performance has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal.
The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period.
The supply of goods made to the consumer's specifications or clearly personalised.
The supply of goods that are likely to deteriorate or expire rapidly.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
8. Guarantee
The products benefit from the legal guarantee of conformity and the guarantee against hidden defects. In the event of a defective product, the Customer may contact Naturopharma's customer service department to obtain a replacement or refund of the product.
9. Liability
Naturopharma cannot be held responsible for damages resulting from improper use of the product purchased. Naturopharma's liability shall in any event be limited to the amount of the order.
10. Personal Data
10.1. Collection and use
The information and personal data collected when the order is placed are necessary for the management of the order and for our commercial relations. It may be passed on to companies that contribute to these relations, such as those responsible for carrying out the services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
10.2. Customer's rights
In accordance with the French Data Protection Act and the RGPD, the Customer has the right to access, rectify, delete and oppose any personal data concerning him or her. 11. Intellectual Property
All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent law. They are the exclusive property of Naturopharma. Any total or partial reproduction or representation of the Site or of all or part of the elements found on the Site is strictly prohibited.
12. Force Majeure
Naturopharma shall not be held liable for failure to perform its obligations in the event of force majeure or any unforeseeable, irresistible and external event preventing or delaying the performance of its obligations.
13. Amendments to the GTCS
Naturopharma reserves the right to modify these GTC at any time. The applicable GTCS shall be those in force on the date of the Customer's order.
14. Applicable Law and Jurisdiction
These GCS are governed by French law. In the event of a dispute, the Antibes courts shall have sole jurisdiction.
